According to Borson, the Premier League can only challenge the appeal board’s decision on three specific grounds: fraud, bad faith, or misapplication of the law. Given the high calibre of the panel—comprised of two former Court of Appeal judges—Borson finds it unlikely that the Premier League could successfully argue misapplication of the law.
